مرحبًا بكم في تطبيق نُوكس (Nooks) المملوك والمشغّل بواسطة مؤسسة نُوكس لتقنية المعلومات، المسجّلة في المدينة المنورة، المملكة العربية السعودية (ويُشار إليها فيما بعد بـ "نحن" أو "المنصة"). باستخدامك للتطبيق فإنك توافق على هذه الشروط والأحكام بالكامل. في حال عدم موافقتك على أيٍّ من هذه الشروط، يُرجى عدم استخدام التطبيق.

نُوكس هو سوق إلكتروني وسيط يربط المستخدمين النهائيين بالمقاهي والمطاعم المحلية المشاركة (ويُشار إليهم بـ "التجار"). نحن لسنا المصنّع أو المُعِدّ للأطعمة والمشروبات المعروضة. المسؤولية الكاملة عن جودة المنتجات وسلامتها الغذائية والتزامها بالأنظمة الصحية تقع على عاتق التاجر المعني.

يتوافق ذلك مع نظام التجارة الإلكترونية الصادر بالمرسوم الملكي رقم م/١٢٦ وتاريخ ١٤٤١/١١/٧هـ، ولائحته التنفيذية الصادرة عن وزارة التجارة.

• يجب ألا يقل عمر المستخدم عن 18 عامًا، أو أن يستخدم التطبيق تحت إشراف ولي أمر.
• يتحمّل المستخدم مسؤولية الحفاظ على سرية بيانات حسابه (رقم الجوال، رمز التحقق OTP).
• يحق لنا تعليق أو إلغاء أي حساب يُساء استخدامه أو يُخالف هذه الشروط دون إشعار مسبق.
• يلتزم المستخدم بتقديم معلومات صحيحة ودقيقة عند التسجيل، ويتحمّل تبعات تقديم بيانات مغلوطة.

• تُعرض الأسعار بالريال السعودي (SAR) وتشمل ضريبة القيمة المضافة ما لم يُذكر خلاف ذلك.
• يحق للتجار تعديل الأسعار وتوفّر المنتجات في أي وقت عبر نظام نقاط البيع (Foodics POS) المتصل بالمنصة.
• يُعتبر الطلب مؤكّدًا بمجرد إتمام عملية الدفع بنجاح واستلام التاجر للطلب.
• قد تُطبّق رسوم توصيل إضافية يتم عرضها بوضوح قبل تأكيد الطلب.

تتم معالجة جميع المدفوعات بشكل آمن عبر بوابة مُيسَّر (Moyasar) المرخّصة من البنك المركزي السعودي (ساما). وسائل الدفع المقبولة:

• بطاقة مدى
• Visa / MasterCard
• Apple Pay

لا تقوم منصة نُوكس بتخزين بيانات البطاقات الائتمانية على خوادمها. جميع بيانات الدفع تُعالج مباشرة بواسطة مُيسَّر وفق معايير PCI-DSS.

يتم التوصيل بالتعاون مع مزوّدي خدمات لوجستية من أطراف ثالثة (مثل: OTO ومرسول وغيرهم). تقوم نُوكس بتنسيق عملية التوصيل، إلا أنها لا تتحمّل المسؤولية عن:

• التأخير الناتج عن حركة المرور أو الظروف الجوية أو عوامل خارجة عن سيطرتنا.
• أي أضرار ناتجة عن سوء التعامل مع الطلب أثناء النقل من قِبَل مزوّد التوصيل.

يحق للمستخدم التواصل مع فريق الدعم في حال وجود أي مشكلة متعلقة بالتوصيل، وسنعمل على حلّها بالتنسيق مع الجهة الناقلة.

جميع حقوق الملكية الفكرية المتعلقة بالتطبيق — بما في ذلك التصميم والشعارات والكود البرمجي والمحتوى — مملوكة لمؤسسة نُوكس لتقنية المعلومات. يُحظر نسخ أو إعادة إنتاج أو توزيع أي جزء من التطبيق دون إذن كتابي مسبق.

يحق لنا تعديل هذه الشروط في أي وقت. سيتم إخطار المستخدمين بالتغييرات الجوهرية عبر التطبيق أو البريد الإلكتروني. استمرار استخدام التطبيق بعد التعديل يُعدّ موافقةً ضمنية على الشروط المحدّثة.

تخضع هذه الشروط لأنظمة المملكة العربية السعودية. أي نزاع ينشأ عن استخدام المنصة يخضع لاختصاص المحاكم المختصة في المدينة المنورة، المملكة العربية السعودية.

Welcome to Nooks, owned and operated by Nooks Technology Est., registered in Madinah, Kingdom of Saudi Arabia (hereinafter referred to as "we," "us," or "the Platform"). By accessing or using the Nooks mobile application, you agree to be bound by these Terms & Conditions in their entirety. If you do not agree to any part of these terms, please refrain from using the application.

Nooks operates as an electronic intermediary marketplace connecting end-users with local coffee shops and restaurants ("Merchants"). Nooks is not the manufacturer, producer, or preparer of any food or beverage listed on the platform. Full responsibility for product quality, food safety, and compliance with health regulations rests solely with the respective Merchant.

This is in accordance with the Saudi E-Commerce Law issued by Royal Decree No. M/126, dated 7/11/1441H, and its implementing regulations issued by the Ministry of Commerce.

• Users must be at least 18 years of age, or use the application under the supervision of a legal guardian.
• Users are responsible for maintaining the confidentiality of their account credentials (phone number and OTP verification codes).
• We reserve the right to suspend or terminate any account that is misused or found in violation of these terms, without prior notice.
• Users must provide accurate and truthful information during registration and bear all consequences of providing false data.

• All prices are displayed in Saudi Riyals (SAR) and are inclusive of Value-Added Tax (VAT) unless otherwise stated.
• Merchants may update product prices and availability at any time through the integrated Foodics POS system.
• An order is deemed confirmed once payment has been successfully processed and the Merchant has received the order.
• Additional delivery fees may apply and will be clearly displayed before order confirmation.

All payments are processed securely through Moyasar, a payment gateway licensed by the Saudi Central Bank (SAMA). Accepted payment methods include:

• Mada debit cards
• Visa / MasterCard credit and debit cards
• Apple Pay

Nooks does not store credit or debit card information on its servers. All payment data is processed directly by Moyasar in compliance with PCI-DSS security standards.

Delivery services are provided in partnership with third-party logistics providers (such as OTO, Mrsool, and others). Nooks coordinates the delivery process; however, Nooks shall not be held liable for:

• Delays caused by traffic conditions, adverse weather, or other circumstances beyond our reasonable control.
• Any damage to the order caused by the delivery provider during transit.

Users are encouraged to contact our support team if they experience any delivery-related issues, and we will work to resolve the matter in coordination with the logistics partner.

All intellectual property rights pertaining to the application — including but not limited to design, logos, source code, and content — are the exclusive property of Nooks Technology Est. Unauthorized reproduction, distribution, or modification of any part of the application is strictly prohibited without prior written consent.

We reserve the right to modify these Terms & Conditions at any time. Users will be notified of material changes via in-app notifications or email. Continued use of the application following any amendment constitutes implicit acceptance of the updated terms.

These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from the use of this platform shall fall under the exclusive jurisdiction of the competent courts in Madinah, Saudi Arabia.
